Service-specific terms for Tusass Business mobile internet

1. Scope of the subscription terms

For agreements with business enterprises on access to Tusass Mobile Internet, which is offered by Tusass, the following service-specific terms apply in addition to "General terms for the delivery and operation of Tusass A/S" services - Business ". In the event of a conflict between the terms, the service-specific terms for Tusass mobile internet precede the general terms.

For subscriptions about Tusass mobile internet access is obtained using Tusass's mobile data service, which gives the customer mobile internet access etc.

The use of mobile data services requires that the customer's terminal equipment is designed for this and that the customer's equipment is properly set up.

2. Prerequisites


It is a prerequisite for the delivery of this subscription agreement that delivery takes place within Tusass's coverage area for mobile coverage. Information about Tusass's mobile coverage area can be obtained from Tusass. If the customer - at the time of the agreement or at a later date - does not have access to Tusass's mobile coverage area, Tusass is not obliged to provide the service.

3. Tusass's delivery obligation, including facilities and functions

It appears from Tusass's product overview for the chosen subscription form, which facilities and functions the customer has access to.


3.A. Operation and speed


Tusass is entitled to make necessary changes to the mobile data service, including among other things. user names, passwords and other codes assigned by Tusass in connection with the subscription, if Tusass deems it necessary for technical, maintenance and operational reasons. Tusass is also entitled to make changes that may be necessary to meet the requirements of the authorities. Any costs incurred by the customer in connection with changes are unauthorized by Tusass, and no claim for damages can be made against Tusass for that reason.

The customer is aware that fluctuations in the communication speed may occur as a result of the service's technical properties.

A connection to Tusass's mobile data service is provided with a specified maximum speed. The speed may vary depending on how many customers are using the mobile / same mast at the same time (shared capacity), and depending on the area in which the customer is located.

Tusass reserves the right to temporarily limit the possibilities for using the Internet service due to operational and security issues.

Tusass also reserves the right (without the customer being entitled to claim compensation from Tusass as a result):

a. To test for open ports (including proxies) as well as open email servers (relays) on the customer's equipment that may cause abuse.

b. Rejecting incoming and outgoing emails that are considered to be eg. virus, spam or phishing.

c. To block third party connections to Tusass's Internet service where the connection is deemed abused, eg. to spread viruses, spam or phishing.

d. To limit the amount of emails per. unit of time.

e. To upgrade server software as necessary.

3.B. roaming


It is not possible to use Tusass mobile internet abroad.


4. Subscription agreement


4.A Payment for subscription

Payment for the subscription is made with bill.

Included mobile data in Tusass Mobile internet subscription only includes consumption in Tusass's mobile network. If the customer's consumption of mobile data exceeds what is included in the subscription, Tusass will charge additional mobile data usage. Appraisal for further usage of mobile data follows Tusass Mobile's every applicable product-specific tariff and is charged separately.

The customer's data usage is calculated for each started 10 KB of data which is sent and / or received.

4.B. Unused subscription


No reimbursement of unused Dual Mobile Internet subscription (wholly or partially) is provided, and unused subscription cannot be transferred to a new period.

4.C. Switching between subscriptions


When the customer changes his Tusass Business Mobile Internet subscription before the 20th of the month, the change enters into force at the next month-end.

When the customer changes his Tusass Business Mobile Internet subscription after the 20th of the month, the change will not take effect until the end of the following month.


5. Customer's responsibility


The customer receives a SIM card upon entering into a subscription agreement, to which are attached 2 secret codes, a Personal Identification Number (PIN) and a Personal Unblocking Key (PUK). PIN and PUK code are used to prevent misuse of the SIM card. The SIM card, PIN code and PUK must be stored separately in a secure manner. The Customer bears responsibility for the misuse of this information by others.

PIN codes, PUK codes and other codes provided by Tusass are Tusass's property and are considered to be returned at the end of the subscription.

It is the customer who is responsible for what information he uses, for example on the Internet.

This includes all information, including information from websites, emails, links, newsgroups or chat groups.

The customer may, when using and downloading material from the Internet or by opening programs in received e-mail, risk infecting his computer with viruses or at the customer's general movement on the Internet being exposed to external influences. Tusass has no influence on these matters and cannot be held liable for damages and losses as a result.

The customer is responsible for all information that the customer makes available to others via the internet service.

The customer must indemnify Tusass in all circumstances in this respect. The customer is also responsible for securing copyrights when using material from the Internet.

If the customer uses the Internet for trading or acquisition of network services, Tusass is without responsibility, as this is merely a balancing act between the customer and a third party.


6. Customer's default


In the event of the customer's material breach of obligations under the use of the mobile data service offered by Tusass, Tusass is entitled to interrupt the customer's access to the service.

The following factors are considered, inter alia, for material breach:

a. The customer scans other computers on the Internet or seeks to gain unauthorized access to hacking systems.

b. The customer's connection is misused with or without the customer's knowledge for example. spread of virus, spam, phishing etc.

c. Customer violates third party copyright by download, distribution or the like.

d. The customer deletes or falsifies transmission information, including ip addresses or header information.

e. The customer repeatedly violates the current unwritten rules for good practice on the Internet.

Discontinuing access to the Internet service does not result in a refusal of the subscription fee for the period in question.

When the customer's connection according to the above is interrupted, Tusass can terminate the subscription agreement without notice.


7. Entry into force


The subscription terms for Tusass Mobile Internet come into force on May 1st, 2019.
